The Secretary can charge fees for guarantees or grants, but the fees must be the same for every rural business investment company. The Secretary cannot charge a fee for guaranteeing a trust certificate under section 2009cc–5, though the Secretary’s agent may collect equal fees for the tasks listed in section 2009cc–5(e)(2). The Secretary can set fees for people applying for a rural business investment company license. Those fees go into the Secretary’s salaries-and-expenses account and can be appropriated as the Secretary decides. No fees may be collected for licenses approved before July 1, 2007 on or after the date this paragraph became law.
