Title 7 › Chapter 51— SUPPLEMENTAL NUTRITION ASSISTANCE PROGRAM › § 2036
The Secretary must buy and send a variety of nutritious food commodities to States for emergency food assistance. For fiscal years 2014 through 2023 the amount to buy is set by a formula: it starts from $250,000,000 in 2009 and for 2010–2023 is adjusted by the percentage change in the thrifty food plan between June 30, 2008 and June 30 of the year before the fiscal year. For 2015–2023 the Secretary must add yearly fixed amounts (2015: $50,000,000; 2016: $40,000,000; 2017: $20,000,000; 2018: $15,000,000; 2019: $23,000,000; 2020–2023: $35,000,000 each). For 2024 and later years the amount is the 2023 total adjusted by the thrifty food plan change between June 30, 2023 and June 30 of the prior year. The money is available for two fiscal years and States may carry over unspent balances under rules the Secretary sets. When buying food, the Secretary should, when practical, consider farm market conditions, what States and distributing agencies need, and what recipients prefer.
