§2110 Refund of Producer Assessments

Summary

A cotton producer who paid an assessment but does not want to support the research and promotion program can ask the Cotton Board for a refund. The producer must make the request personally, use the Board’s approved form, file within the time limit the Board sets and the Secretary approves (that time must be at least 90 days), and show proof they paid the assessment. The Board must pay the refund within 60 days of the request. The right to get a refund ends if a proposed change to the order that implements the Cotton Research and Promotion Amendments Act of 1990 is approved in the referendum required by section 2107. If approved, the refund right stops 30 days after the Secretary announces the vote. If a later referendum disapproves that amendment, the refund right is restored.
