If you must follow an order, you can send a written request to the Secretary saying the order or part of it is not lawful and asking to change it or be excused. You will get a hearing under the Secretary’s rules. The Secretary will decide, and if the decision follows the law it is final. If you still disagree, you can ask a U.S. district court where you live or have your main business to review the decision. You must file a complaint within 20 days and give the Secretary a copy. If the court finds the decision unlawful, it will send the case back with instructions to make a lawful decision or take more steps. Filing a petition or lawsuit does not stop the government from seeking relief under section 2112(a).
