A U.S. district court clerk must, when asked by a party, issue a subpoena for any witness who lives in the district or within 100 miles of the place named. The subpoena orders the witness to appear and give testimony before an official who can take depositions and affidavits. Federal civil rules about witnesses and producing documents apply to contested cases in the Plant Variety Protection Office when they fit the office’s rules. Witnesses get the same fees and travel pay as for district courts. A judge can enforce the subpoena or punish refusal, but a witness won’t be punished unless their one‑day fee and travel pay were paid or offered when served. A witness also can’t be forced to reveal private information unless the issuing court or the Secretary orders it.
