Anyone in the United States who practices before the Office of Plant Variety Protection while suspended or excluded, or who is not admitted to practice, can be sued to give back money, pay for harm, and be stopped from practicing. They do not have to pay damages if they prove the work was competent and not negligent. The rule does not apply to people supervised by an admitted, responsible practitioner or to those acting only as regular employees.
