§2423 Joint Breeders

Summary
One breeder (or that breeder’s successor) can file the plant variety protection application and name the other breeders, and after giving any notice the Secretary requires, the Secretary can grant the plant variety protection certificate to the applicant and to any other breeders (or their successors) who later join the application.

Title 7, §2423

(a)When two or more persons are the breeders, one person (or the successor of the person) may apply, naming the others.
(b)The Secretary, after such notice as the Secretary may prescribe, may issue a certificate of plant variety protection to the applicant and such of the other breeders (or their successors in interest) as may have subsequently joined in the application.
