Plant variety protection applications and their contents must be kept confidential by the Plant Variety Protection Office, the Board, and USDA offices given access. They cannot be released without the owner's permission unless the Secretary finds special circumstances. The Secretary may publish the variety name, kind, applicant, and whether sales are limited to that variety as certified seed.
