When the agency decides to grant a plant variety protection certificate, it must send the owner a written notice saying the certificate will be allowed and stating the amount of the issue fee. The owner must pay that fee within one month. Once the fee is paid on time and the seed deposit required under section 2422(3) has been made, the certificate will be issued. If the fee is late but paid within nine months after the due date with an extra charge set by the Secretary, or within any longer time the Secretary allows, the payment will be accepted.
