Title 7 › Chapter 58— POTATO RESEARCH AND PROMOTION › § 2618
Plans under this chapter may include several optional rules. They can allow the board to exempt potatoes used for nonfood purposes if there are safeguards. They can set different handler payment and reporting schedules for different areas. They can fund advertising and sales promotion aimed at increasing general demand for potatoes and potato products, as long as those promotions follow section 2617(f). They can fund research and development to improve potato marketing and use. They can build reserve funds from assessments, but the reserve cannot exceed the amount budgeted for two years’ operation. With the Secretary’s approval, funds can be used to help sell potatoes abroad. Plans can also allow assessments on imported tablestock, frozen or processed potatoes for human consumption, and on seed potatoes. Other terms needed to carry out the plan are allowed if they are not inconsistent with the chapter. Any producer or importer who was assessed and does not want to support the program can ask for a refund. The request must be made in person, on a board form and within the time the board sets and the Secretary approves, but that period cannot be less than 90 days. The requester must prove they paid the assessment. The board must pay the refund within 60 days after the request.
