Title 7 › CHAPTER 58 — POTATO RESEARCH AND PROMOTION › § 2619
People who handle potatoes that the board names must pay any assessment on those potatoes to the board. They may collect that money from the growers or take it out of what they pay the grower. Each handler must keep a separate record for every grower showing how many potatoes they handled, which ones the plan covers, and which are exempt, plus any other details the board requires. The board can treat different handlers or areas differently to match how they sell potatoes. No potato can be charged more than one assessment. If importers are covered by the plan, importers the board names must pay assessments when the potatoes enter the United States. For imported tablestock, frozen, processed for human consumption, and seed potatoes, the board must make the import assessment equal to the assessment on U.S. potatoes. Importers must keep separate records of quantities imported and which are covered or exempt. Handlers and importers must keep and file the books and reports the plan requires and let the Secretary inspect them. The information is kept confidential and can only be shown in a court or hearing involving the plan at the Secretary’s request. General summaries that do not identify people are allowed, and the Secretary can publish the names of plan violators and what they did. Any USDA officer or board employee who wrongfully reveals confidential information can be fined up to $1,000, jailed for up to one year, or both, and removed from office.
