Title 7 › CHAPTER 65 — WHEAT AND WHEAT FOODS RESEARCH AND NUTRITION EDUCATION › § 3404
An order under this chapter must include one or more of these kinds of rules, and no others except as allowed by section 3405. It can require nutrition education programs about wheat and wheat products at home and abroad and provide money for them, but it cannot favor a private brand if that would unfairly harm others or use unfair or deceptive practices. It can fund research or studies about producing, selling, marketing, using, or making new wheat products to help expand or improve their use. An order can require processors, distributors, and product makers to keep books and file reports the order asks for; those records are kept confidential except for general statistics, refund summaries, or the name of someone found to have violated an order. Employees who illegally disclose such information can be fined up to $1,000, jailed up to one year, or both, and Council or Department officers may be removed. Orders can also exempt certain end products from assessments under section 3405 and include other incidental terms that do not conflict with this chapter and are needed to carry out the order.
