The Secretary must hold a referendum as soon as possible among end product manufacturers who were making end products during a representative period before the vote (the Secretary picks that period). Manufacturers who are not exempt can register by mail to vote. Registration must end at least 30 days before the referendum. Within 10 days after that, the Secretary will decide who can vote and make a list public, then send ballots to those who registered and are eligible. An order only takes effect if at least 50 percent of the registered manufacturers cast votes, and either two-thirds of those voting approve it, or a majority approve and that approving majority made at least two-thirds of the processed wheat in all votes during the representative period. When registering, each manufacturer must state how much processed wheat it made in that period. The Secretary is paid back from Council fees for referendum costs. Voter lists and ballots must be kept at least 12 months for any audit or recount.
