§4309 Suspension and Termination of Orders

Summary

The Secretary must stop or pause any order, or part of an order, that gets in the way of or does not help the law’s goals. The Secretary can hold a vote (referendum) anytime and must hold one if at least 10 percent of the producers and importers who approved the order ask for it. If a majority of those producers and importers who, during a period the Secretary chooses, were making or importing flowers and plants vote to end or pause the order, the Secretary must suspend or end it six months after deciding the vote favors that action. Ending or pausing an order is not treated as an "order" under the law.
