§4311 Exemption From Assessments

Summary

Producers or importers whose total sales do not exceed $100,000 during the twelve consecutive months before an assessment is due are exempt from paying assessments and cannot vote in any referendum, subject to the conditions and procedures set by the program’s order or rules. The Floraboard may raise the exemption level each year to adjust for inflation. When counting total sales, include these related sales: for an individual, sales by their spouse, children, grandchildren, and parents; for a partner, sales by the other partners; for a corporation, sales of any subsidiaries it owns 50 percent or more of or controls. Also count sales of any corporation in which the producer or importer owns 50 percent or more of the stock, and treat stock owned by the listed family members, partners, or qualifying corporations as if the producer or importer owned it.
