Title 7 › Chapter 74— FLORAL RESEARCH AND CONSUMER INFORMATION › § 4315
The Secretary must approve whether an organization can represent U.S. flower and plant growers or importers when the group asks for an official order or makes nominations under the law. The decision is based on other information and a factual report the organization must give the Secretary. The Secretary looks at 8 things in that report: where the members operate; the size and makeup of membership and the share of production or imports by state or country; how members help set policy; proof the group is stable; where its money comes from; what the group does; whether most of the board are producers or importers; and whether the group can and will carry out the law’s goals.
