When the Secretary must decide if producers approve or disapprove something under this law, a vote by a cooperative that genuinely markets milk or milk products must be treated as the vote of the cooperative’s members and contract producers. If a cooperative votes for its members, it must send each affected producer, at least 30 days before the referendum, a plain description of the question, a statement of how the cooperative will vote, an official ballot, and instructions for casting an individual ballot. The Secretary will count the ballots and adjust the cooperative’s vote to reflect any individual votes.
