The Secretary must hold a vote (referendum) of honey producers, importers, and handlers who were active during a representative period the Secretary sets, except those exempt under section 4606(e)(4). An order only takes effect if more than half of the voters approve it and those approving persons account for at least 50 percent of the honey produced, imported, or handled by voters. The Secretary can change orders using the usual procedures, but cannot change parts that need referendum approval unless they get the same kind of approval. A person who both produces and handles (producer-packer) or who imports and handles gets 1 vote as a handler and 1 vote as a producer or importer (unless exempt). The amounts of honey for which they owe assessments count with the corresponding vote. Ballots and any reports that could identify how someone voted must be kept strictly confidential.
