Title 7 › Chapter 80— WATERMELON RESEARCH AND PROMOTION › § 4904
When watermelon producers, handlers, or importers give enough evidence, or when the Secretary thinks a plan would help carry out the law’s policy, the Secretary must give notice and allow a hearing on the proposed plan. Producers, handlers, importers, or any other interested person (including the Secretary) can ask for that hearing, but the request must include a proposed plan. After the hearing, the Secretary will issue a plan only if the evidence shows the plan and its terms will help carry out the law’s policy. The Secretary must explain those findings in the issued plan.
