Title 7 › Chapter 21— TOBACCO STATISTICS › § 501
The Secretary of Agriculture must gather and publish counts of leaf tobacco in the United States and Puerto Rico that are held by dealers, manufacturers, cooperatives, warehousemen, brokers, holders, or other owners (not the original growers). The counts must break tobacco down by type, grade groups, and other useful divisions like quality or color, and be summarized as of January 1, April 1, July 1, and October 1 each year, with an annual report. The Secretary may skip manufacturers who, in the first three quarters of the prior year, made less than 35,000 pounds of tobacco, cigar makers who made less than 185,000 cigars, or cigarette makers who made less than 750,000 cigarettes (based on tax or Puerto Rico records). The Secretary may also omit anyone holding less than 50,000 pounds on the report date. Tobacco that is not marketable or not suitable for making tobacco products must be listed as nondescript and reported in the “N” group for its type.
