Title 7 › Chapter 21A— TOBACCO INSPECTION › § 511s
By March 31, 2002, the Secretary of Agriculture must hold votes among growers of each kind of tobacco that gets price support under the Agricultural Act of 1949. If more than half of the growers who vote say yes, that kind of tobacco must be graded when it is sold, starting in the 2002 marketing year and in later years. As much as possible, the Secretary should set up, collect, and use fees for this grading the same way auction grading user fees are handled under the Tobacco Inspection Act. The Secretary’s decision cannot be reviewed by a court.
