The Secretary must make contract payments for a fiscal year as soon as possible. If someone disagrees about whether they can enter a contract or get payments, or about how much they should get, they can appeal to the county committee for the county or area where their farm is located (see section 590h of title 16). If the county committee gives an unfavorable decision, that decision can be appealed to the National Appeals Division (created under the Department of Agriculture Reorganization Act of 1994, 7 U.S.C. 6991 et seq.). The Secretary can use a bank or other financial institution to manage assets and make contract payments. A tobacco quota holder or a producer of quota tobacco who is due contract payments may assign the right to receive those payments to a financial institution. Once the Secretary is notified of that assignment, payments will be sent directly to the named financial institution. The Secretary must give tobacco quota holders and producers information about this option so they can choose to get a lump sum or other payment through a financial institution.
