Exporters and other program participants must keep all records about a program transaction for up to 5 years after it is finished and let the Secretary review those records during that time. Personal data in reports can be kept from public release under federal disclosure rules. Any Agriculture Department employee who knowingly reveals confidential information can be punished under federal law. Nothing here lets officials refuse information to Congress. If someone commits fraud or breaks the program rules, the Commodity Credit Corporation can make them pay for losses, demand repayment of aid plus interest, and charge extra damages. After a hearing, the Corporation can also suspend or bar a person from the programs for one year or longer. False certifications are subject to federal false-statement laws.
