The Secretary must set up an advisory council to give advice and recommendations to the Secretary and the Director about the program’s activities, policies, and operations. The council will have certain ex officio members (their job titles or designees): the Director, the Assistant Secretary for Science and Education, the Directors of the National Agricultural Library, the National Institutes of Health, and the National Science Foundation, the Secretary of Energy, the Director of the Office of Science and Technology Policy, and any other federal officers the Secretary thinks are needed. The council may have up to 13 members appointed by the Secretary. Appointed members must include 6 leaders from relevant sciences (like agricultural, environmental, health, economics), 3 public leaders (such as policy or community development experts), 4 experts in public cultivar and animal breed development, and 4 people representing 1862, 1890, Hispanic-serving, or 1994 institutions. Appointed members serve without pay but can get travel expenses and per diem under federal rules. Their term is 4 years, with staggered expirations, and a member may stay on until a successor is named. A member cannot be reappointed until 2 years after their term ends. Vacancies must be filled within 90 days. The Secretary picks a chair from the appointed members for a 2-year term. The council must meet at least twice each fiscal year when called by the chair or requested by the Director. The Director must provide staff, information, and training. The council can prepare reports and recommendations, and it is not subject to the usual federal advisory committee termination rule in 5 U.S.C. 1013(a).
