§6103 Issuance of Orders

Summary

The Secretary must create a single national order under this chapter that applies to mushroom producers, importers, and first handlers. Only one such order can be in effect at a time. The Secretary or a mushroom producers’ group or any affected person can ask for an order and send a proposal. Within 60 days of getting a proposal or when the Secretary decides to propose one, the proposed order must be published and opened for public comment. After considering comments, the Secretary will issue the order, and if producers and importers approve it as in section 6105(a), it must take effect no later than 180 days after publication. The Secretary may later change the order, and the same chapter rules apply to those changes.
