Title 7 › Chapter 92— SOYBEAN PROMOTION, RESEARCH, AND CONSUMER INFORMATION › § 6306
A person who is under an order can file a petition with the Secretary saying the order or part of it was not made according to law and asking to change the order or be excused from it. The person must be given a hearing under rules the Secretary makes. After the hearing, the Secretary will decide, and that decision is final if it follows the law. If the person is unhappy with the Secretary’s decision, they can ask a U.S. district court where they live or do business to review it by filing a complaint within 20 days after the Secretary’s decision. Papers must be served under the Federal Rules of Civil Procedure. If the court finds the decision broke the law, it will send the case back to the Secretary with directions to issue the lawful ruling or to take further steps the court requires. Having a petition pending does not stop the Attorney General or the Secretary from acting under section 6307.
