Title 7 › CHAPTER 93 — PROCESSOR-FUNDED MILK PROMOTION PROGRAM › § 6407
Establish a National Processor Advertising and Promotion Board to run advertising, research, and promotion programs only for fluid milk. The Secretary must set 12 to 15 regions and appoint one fluid milk processor from each region to the Board. The Secretary also picks five at-large members, with at least three processors and at least one member from the general public. Board members serve 3-year terms, with the first group staggered for 1, 2, or 3 years. No one may serve more than two back-to-back terms, though those first short-term appointees can be reappointed to a full 3-year term. Board members are not paid, but they are reimbursed for necessary expenses. The Board must run programs that benefit the fluid milk industry, try to match advertising in each region to the funds collected there, write rules, take complaints, hire staff, enter contracts (with Secretary approval), and submit a yearly budget to the Secretary before each fiscal year. All program costs are paid from assessments collected under the order. The Board may invest those funds only in U.S. or state obligations, certain bank accounts or CDs, or obligations guaranteed by the U.S., and any income may be used for program purposes. One year after the Board starts, it may not spend more than 5% of assessments on administration. Contracts must include a program plan, a budget, Secretary approval, and recordkeeping. Processors must keep required records for 2 years after the fiscal year and make them available for inspection; the Board must keep books, have an independent audit each year, and report to the Secretary. Collected commercial or financial information is confidential except for limited law-enforcement sharing, non‑identifying statistics, or naming violators when directed by the Secretary. Violating confidentiality can bring a fine up to $1,000, up to 1 year in jail, or both, and removal from office for Board agents or Department employees. Board funds may not be used to influence legislation or government action, except when proposing changes to the order. Exported fluid milk is exempt from assessments. The Secretary will order an annual independent evaluation of the program, and the Board must coordinate with the National Dairy Promotion and Research Board. The order may include other necessary rules, such as late payment charges.
