Title 7 › Chapter 93— PROCESSOR-FUNDED MILK PROMOTION PROGRAM › § 6415
Secretary can change the order and can hold a referendum anytime to adjust the assessment rate for fluid milk processors. The Secretary must hold a referendum if the Board or a group that together sold at least 10% of total fluid milk volume in a Secretary-set period asks for one. A rate change only happens if at least 50% of voting processors approve and those voters represent at least 60% of the volume in that period. The new rate starts on a date the Secretary sets but no later than 30 days after the vote. Rules in section 6413(c) and (d) also apply.
