FDA must not enforce the final rule that would lower the allowed selenium in animal feed unless the FDA Commissioner finds all of the following: the allowed selenium levels are not needed to keep animals healthy, are unsafe for animals or people who eat animal products, do not support normal growth and reproduction, and cannot be controlled by current good manufacturing practices. The final rule is the one published in the Federal Register on September 13, 1993 (58 Fed. Reg. 47962) and any modification made after October 13, 1994.
