Secretary may create an Under Secretary of Agriculture for Marketing and Regulatory Programs. If created, the President appoints the Under Secretary and the Senate must confirm. The Under Secretary will oversee agricultural marketing, animal and plant health inspection, grain inspection, and packers and stockyards, and will do other duties required by law or assigned by the Secretary. A person serving as Assistant Secretary for Marketing and Regulatory Programs on October 21, 1998, who was appointed by the President and confirmed by the Senate, does not need a new appointment if the Secretary moves that person into the new Under Secretary post within 180 days after October 21, 1998 (or a later date the Secretary sets if litigation delays the change).
