The Secretary can issue and change national orders that apply to producers, first handlers and others in the marketing chain, and to importers when imports are charged an assessment. A proposed order can be written by the Secretary or sent in by a producer group or any person who would be affected. If the Secretary finds the proposal fits the program’s goals, the Secretary must publish it in the Federal Register and allow public comment. The Secretary must consider those comments and make the final order meet the program’s rules. If the final order is approved, the Secretary must issue it. Except when an initial referendum is required, the final order must take effect no later than 270 days after the proposed order was published. The Secretary may later amend orders following the required procedures.
