Title 7 › CHAPTER 101 — AGRICULTURAL PROMOTION › SUBCHAPTER II — ISSUANCE OF ORDERS FOR PROMOTION, RESEARCH, AND INFORMATION ACTIVITIES REGARDING AGRICULTURAL COMMODITIES › § 7414
Require a board to run a program of generic promotion, research, and information for the covered agricultural commodity and put specific rules into each order to make that happen. The Secretary picks board members (producers, first handlers, others in the marketing chain, and importers if they are assessed), may include public members and alternates, and can use nominations set by the order. Boards must reflect the U.S. geographic distribution of production and imports. At least once in each 5-year period, but not more often than once in each 3-year period, the board must review geography and imports and, if needed, suggest changing membership. Members serve 3-year terms (initial appointments may be 2, 3, or 4 years), may serve no more than 2 consecutive terms, and stay on until successors are named. Members get no pay but may be reimbursed for approved travel. Orders must spell out the board’s powers: run the order, collect assessments, hire staff, make bylaws, submit yearly budgets and plans for approval, borrow startup funds, enter approved contracts, keep records, investigate complaints, and recommend changes. Boards may not have conflicts of interest, use funds to lobby, or run false or disparaging ads. Boards must keep records, have annual independent audits sent to the Secretary, require independent evaluation of programs, and require covered persons to keep and allow inspection of records. Information is confidential except in limited cases; willful wrongful disclosure can bring up to $1,000 fine, up to 1 year in jail, or both. Congress may still get required information.
