Gives people under an order the right to ask the Secretary to change the order or to excuse them. They must explain why the order or any duty tied to it is not lawful and ask for a modification or an exemption. The Secretary must offer a hearing under rules the Secretary makes and then issue a decision. Petitions must be filed within 2 years after the order, rule, or obligation takes effect. The Secretary’s decision is final unless the person asks a court to review it. To get court review, file in the U.S. district court where you live or do business within 20 days after the Secretary’s final decision. You may serve the Secretary by giving the Secretary a copy of the complaint. If the court finds the decision unlawful, it will send the case back with instructions on what the Secretary must do. Filing a petition or court case does not stop enforcement actions under section 7419.
