Title 7 › CHAPTER 101 — AGRICULTURAL PROMOTION › SUBCHAPTER III — CANOLA AND RAPESEED › § 7444
Creates a National Canola and Rapeseed Board of 15 members to run the program and says how the Board must be set up and run. The Board must have 11 producer members and 4 industry members. The producer seats come from 6 geographic regions (1 from each region plus 5 more seats split by production), and no more than 4 producer members can be from any one State. The Board must review the geographic distribution of production at least once every 3 years and not more often than once every 2 years and can ask the Secretary to change regions or seats. State organizations that represent producers must be certified by the Secretary based on stability and membership or purpose. Board members serve 3-year terms (initial members staggered 1, 2, or 3 years), may not serve more than two consecutive 3-year terms, and must serve without pay but can be reimbursed for reasonable expenses. The Board must run the program under the order, make rules, hire staff, set budgets and assessment rates for the Secretary’s approval, run research and promotion projects, enter contracts, keep records, and have an independent audit every year. All programs and budgets need the Secretary’s approval before starting. The Board cannot use funds to influence legislation, create conflicts of interest, run false advertising, or disparage other commodities, though it may suggest order changes, share information with officials, or market to foreign governments. Producers, first purchasers, and industry members must keep records and give reports. Those records are confidential except in certain cases, and anyone who knowingly breaks that confidentiality can be fined up to $1,000, jailed up to 1 year, or both; Board or Department employees can also be removed. Assessment money must pay program and admin costs and keep a reasonable reserve. Other necessary terms may be added by the Secretary.
