Title 7 › Chapter 102— EMERGENCY FOOD ASSISTANCE › § 7505
The Secretary must quickly provide food commodities to State agencies picked by the Governor or another state official so those agencies can give the food to eligible local groups. The Secretary can also send food straight to eligible local groups or to private companies that process the food for those groups under section 7504. States may choose to give priority to existing food bank networks and other groups whose main job is getting food to low-income households. State agencies must move the food out quickly, in the amounts asked for when possible. If a State cannot fill all requests for a particular food, it must first give that food to agencies helping people in emergencies or distress, including low-income and unemployed people. States should encourage distribution in rural areas. For food meant for individual households, States must give it to groups that serve needy people and, with the Secretary’s approval, decide who counts as needy. States may make agreements with other States to share or send food to feeding groups that serve areas crossing state lines.
