§7702 Definitions

Article — any physical object that might carry plant pests or harmful weeds. Biological control organism — an enemy or competitor used to control a plant pest or noxious weed. Enter/Entry — the act of bringing something into U.S. commerce. Export/Exportation — moving something out of the United States. Import/Importation — bringing something into U.S. territory. Interstate — movement from one State to another or within places like DC, Guam, Puerto Rico, the Virgin Islands, or other U.S. territories. Interstate commerce — trade or transport between States or within those territories. Means of conveyance — any property used to move other property. Move/Moving/Movement — to carry, ship, mail, transport, import, release, offer, receive, help, or allow those actions. Noxious weed — a plant or plant product that can harm crops, animals, navigation, natural resources, public health, or the environment. Permit — written or oral permission (including electronic) from the Secretary to move covered items under set conditions. Person — an individual or any type of business or legal entity. Plant — any plant or plant part that can be propagated (examples listed). Plant pest — living organisms or agents that can harm plants, including protozoans, animals, parasitic plants, bacteria, fungi, viruses/viroids, and similar agents. Plant product — flowers, fruit, vegetables, seeds not counted as “plant,” or processed plant parts. Secretary — the Secretary of Agriculture. State — any U.S. State or U.S. territory or possession. Systems approach — a set of plant-health steps that includes at least two separate measures that reduce pest risk. “This chapter” — the chapter and any rules the Secretary issues under it. United States — all of the States.
