Title 7 › CHAPTER 104 — PLANT PROTECTION › SUBCHAPTER I — PLANT PROTECTION › § 7717
The Agriculture Secretary must run a program to control grasshoppers and Mormon crickets on Federal lands to protect rangeland when money is available. The Interior Secretary must, on request, transfer no‑year appropriations to the Agriculture Secretary to pay for outbreak prevention and control on Interior‑managed Federal lands. Transfer requests must be made promptly. Transferred funds cannot be spent until funds specifically appropriated for grasshopper control are used up. The transferred money must later be replenished by supplemental or regular appropriations requested promptly. On request by the agency in charge or a State agriculture department, the Agriculture Secretary must quickly treat Federal, State, or private lands that reach economically damaging infestation levels, unless a delay won’t cause greater economic harm to nearby rangeland owners. The Secretary will work with other Federal, State, and private programs. The federal government will pay 100% of costs on Federal lands, 50% on State lands, and 33.3% on private lands. The Agriculture Secretary must also fund training for personnel using the available or transferred funds.
