The Secretary may stop and inspect a person or vehicle without a warrant in specific situations. These include anyone coming into the United States, anyone in interstate travel if there is probable cause, and anyone moving in or out of a state area or premises under an emergency quarantine under section 7715 when there is probable cause. Inspections cover plants, plant products, pests, noxious weeds, biological control organisms, and similar regulated items. All actions must follow rules approved by the Attorney General. With a warrant, the Secretary can enter U.S. premises to investigate, inspect, or seize regulated items. A federal judge, a judge of a court of record, or a U.S. magistrate judge may issue such a warrant on probable cause within their jurisdiction. The warrant can be requested and carried out by the Secretary or by a U.S. Marshal.
