The Secretary must make direct payments to producers for covered commodities for each 2002 through 2007 crop year on farms that have payment yields and base acres. The payment rates are: wheat $0.52 per bushel; corn $0.28 per bushel; grain sorghum $0.35 per bushel; barley $0.24 per bushel; oats $0.024 per bushel; upland cotton $0.0667 per pound; rice $2.35 per hundredweight; soybeans $0.44 per bushel; and other oilseeds $0.0080 per pound. The payment for a farm and commodity is the rate times the farm’s payment acres times the farm’s payment yield. Payments for the 2002 crop year must be made as soon as practicable after May 13, 2002. For 2003 through 2007, payments may not be made before October 1 of the year the crop is harvested. Producers may choose to receive part of the payment in advance: up to 50% for 2003–2005, up to 40% for 2006, and up to 22% for 2007. The advance can be paid in any month from December 1 of the year before harvest through the month the payment would normally be made, and producers can change that month with advance notice. If a producer stops producing on the farm or changes their share of risk before the rest of the payment is made, the producer must repay the applicable advance amount as determined by the Secretary.
