For the 2002 through 2007 crop years, farmers who would qualify for a loan deficiency payment (LDP) for wheat, barley, or oats but choose to graze those acres can get a payment if they sign an agreement to not harvest the crop. The same rule applies to triticale acres used for grazing, but the payment for triticale is calculated using the wheat LDP rate and wheat payment yield. The payment equals the county LDP rate in effect on the agreement date multiplied by the grazed acres times the payment yield used for direct payments for that crop (or a yield the Secretary sets if none exists). Payments are made at the same time and in the same way as LDPs. Crops grazed under the agreement cannot get federal crop insurance indemnity or noninsured crop assistance.
