The Secretary of Agriculture and the Secretary of Health and Human Services must work together to manage biological agents and toxins that are covered by both the HHS program and the Agriculture program. "Overlap agent or toxin" means an agent or toxin listed under both programs. "Section 351A program" is the HHS program under the Public Health Service Act. "Section 212 program" is the Agriculture program under this Act. The two agencies must try to avoid conflicting rules, reduce extra paperwork for people who fall under both programs, keep agents available for legitimate research or education, and make sure registration data for overlap agents is in both agencies’ national databases. Soon after June 12, 2002, the two Secretaries must create a written agreement (a memorandum of understanding) that, among other things, sets up one registration system: one form that collects all needed information, a choice to file that form with either agency, rapid sharing of the form between agencies, confirmation that both programs’ requirements are met, notice if a registration is denied, and entry of registrations into both national databases. The agreement must also let people submit Attorney General identifying information to either agency (not both) to satisfy both programs, require the agencies to share that Attorney General information, and require them to agree on who gets access. The agencies may share inspection and enforcement duties, with or without payment. The memorandum must be put in place no later than 180 days after June 12, 2002. Until the single system is ready, people must register under both programs. Within 18 months after the single system is in place, the two Secretaries must issue joint rules that meet both programs’ requirements.
