Marketing agreements made under section 852 may only include terms the Secretary approves at the hearing required by section 852, and only if those terms help carry out the goals in section 851. The Secretary may require terms from subsection (7) of section 608c, or require each manufacturer to keep, on April 1, a reserve of finished serum equal to at least 40% of the manufacturer’s previous year’s serum sales. A manufacturer can apply in writing before September 1 of the preceding year to use another date between January 1 and May 1; the Secretary may set conditions. Serum counted for one manufacturer’s reserve cannot be counted for another.
