The Commission must pick a money penalty that fits how serious the violation was. If someone is fined and, within 15 days after the payment deadline, does not convince the Commission that they either appealed or paid the full amount, then when those 15 days end they automatically lose privileges at all registered entities and, if they are registered, their registration is suspended until they show the Commission they paid the full amount with interest to the payment date. If a person appeals and the Commission wins or the appeal is dismissed, that person has 30 days from the court judgment to pay in full. If they do not, the same automatic loss of privileges and suspension apply. A designated clearing organization, a swap dealer, or a major swap participant that knowingly or recklessly evades or helps others evade the requirements of section 2(h) must pay a penalty equal to twice the usual amount for violating section 2(h).
