Title 8 › CHAPTER 12 — IMMIGRATION AND NATIONALITY › SUBCHAPTER III — NATIONALITY AND NATURALIZATION › Part II — Nationality Through Naturalization › § 1440f
The Secretary of Homeland Security must use fingerprints a person gave when they enlisted in the U.S. Armed Forces or when they filed for adjustment of status to complete the background and security checks for a naturalization application, if the person is eligible under sections 1439 or 1440, was fingerprinted under Department of Defense rules at enlistment, applied for naturalization or filed adjustment of status within 24 months of enlistment, and the Secretary finds the biometrics are enough. A person can still give new biometric data. If new prints would speed up the case, the Secretary must tell the person and explain how to submit them. The Secretary and the Secretary of Defense will agree on acceptable formats. Defense must provide prints free and help. Not later than one year after June 26, 2008, DHS, DoD, and the FBI must set up fast electronic transfer of biometrics. DHS must centralize overseas active-duty naturalization cases and, with the FBI and DNI, finish them within 180 days after all background-check responses arrive.
