Title 8 › Chapter 14— RESTRICTING WELFARE AND PUBLIC BENEFITS FOR ALIENS › § 1601
Congress says immigrants must be self-reliant and not depend on public benefits. Immigrants should use their own skills, family, sponsors, or private groups instead of government help. Public benefits must not be a reason people come to the United States. Because more immigrants have been getting federal, state, and local benefits and current rules and weak sponsor agreements haven’t stopped that, the government has a strong interest in making new rules on who can get benefits and how sponsors must support immigrants. If a State uses the same federal categories to decide benefit eligibility, the State is treated as using the least restrictive way to meet that goal.
