Title 8 › CHAPTER 14 — RESTRICTING WELFARE AND PUBLIC BENEFITS FOR ALIENS › SUBCHAPTER IV — GENERAL PROVISIONS › § 1645
Allows an immigrant to count Social Security work credits earned by a parent before the immigrant turned 18, and to count work credits a spouse earned while they were married if the immigrant is still married to that spouse or the spouse has died. If the parent or spouse received any federal means-tested public benefit during the period, then any work credits that begin after December 31, 1996 cannot be used for this purpose (see section 1613 for the benefit definition). The Social Security Commissioner may share these work-credit records with a government agency for the chapter’s purposes, even if other disclosure rules would normally apply.
