Title 8 › Chapter 15— ENHANCED BORDER SECURITY AND VISA ENTRY REFORM › Subchapter V— FOREIGN STUDENTS AND EXCHANGE VISITORS › § 1762
Requires the Commissioner of Immigration and Naturalization, with help from the Secretary of Education, to review schools certified to enroll F, M, or J nonimmigrants no later than two years after May 14, 2002 and then every two years. Reviews must check whether the schools follow the recordkeeping and reporting rules for those students and the rules in section 1372. The Secretary of State must do the same every two years for organizations that sponsor J exchange visitors. If a school or sponsor seriously fails to follow those recordkeeping or reporting rules, the Commissioner may suspend a school’s approval for at least one year or end it, and the Secretary of State may suspend or end a sponsor’s designation for at least one year. Each official can choose suspension or termination.
