People who apply for a Form I–94 must pay an extra fee in addition to any other fees. For fiscal year 2025 the fee will be whichever is larger: $24 or a different amount that the Secretary of Homeland Security sets by rule. Starting in fiscal year 2026 and each year after, the fee will be last year’s fee plus an increase based on the change in the Consumer Price Index for All Urban Consumers for July compared to July of the prior year, and the total will be rounded down to the nearest dollar. Each year, 20 percent of the fees will go into the Land Border Inspection Fee Account and be made available to U.S. Customs and Border Protection to use for processing I–94s without further appropriation. Any fee money not put into that account will go to the general fund of the Treasury. These fees cannot be waived or reduced.
