§1807 Form I–94 Fee

Summary

Anyone who applies for a Form I–94 must pay a fee, in addition to any other required fees. For fiscal year 2025 the fee will be at least $24, or a higher amount if the Secretary of Homeland Security sets one. Starting in fiscal year 2026 and every year after, the fee will be last year’s fee plus an increase based on the change in the Consumer Price Index for All Urban Consumers for July, compared to the same month the year before, with the result rounded down to the nearest dollar. Each year 20 percent of the fees collected goes into the Land Border Inspection Fee Account and is available to U.S. Customs and Border Protection to keep and spend without further approval for processing Form I–94. Any remaining fees go to the U.S. Treasury’s general fund. The fee cannot be waived or reduced.
