Title 8 › Chapter 16— IMMIGRATION FEES › § 1808
If an immigrant’s asylum application stays pending, they must pay a yearly fee for each calendar year it remains pending. The fee is required by the Secretary of Homeland Security or the Attorney General, and it is in addition to any other fees the person might owe. For fiscal year 2025 the fee is whichever is higher: $100 or an amount the Secretary of Homeland Security sets. Starting in fiscal year 2026 and each year after, the fee will be last year’s fee plus an increase based on the percent change in the Consumer Price Index for All Urban Consumers for July compared with the same month the year before, rounded down to the nearest dollar. All money collected goes into the Treasury’s general fund, and the fee cannot be waived or reduced.
