Ten-year export ban for individual
Because he was convicted on September 6, 2023, Eric Nana Kofi Ampong-Coker is denied the right to export items subject to the Export Administration Regulations for 10 years, until September 6, 2033. The Order is effective immediately (issued December 31, 2024) and bars him from applying for or using BIS licenses or participating in export-related transactions during that period.
Revocation of BIS-issued licenses
Any Bureau of Industry and Security (BIS) licenses or other authorizations in which Ampong-Coker had an interest at the time of his conviction are revoked. The revocations take effect as part of the denial order tied to his conviction.
Third parties barred from dealing with denied person
The Order forbids any person from exporting to or on behalf of Ampong-Coker, facilitating his acquisition or control of exported items, acquiring items from him, obtaining items from him with knowledge they will be exported, or servicing items owned or controlled by him if that servicing uses items subject to the Regulations. These prohibitions run through September 6, 2033.
Related entities may be covered to prevent evasion
The Order states that any person, firm, corporation, or business organization related to Ampong-Coker by ownership, control, position, affiliation, or other connection may also be made subject to the Order to prevent evasion. This measure is aimed at stopping attempts to circumvent the denial.
Right to appeal the denial order
Ampong-Coker may file an appeal of this Order with the Under Secretary of Commerce for Industry and Security. The appeal must be filed within 45 days from the date of this Order and must follow the Rules in part 756 of the Regulations.
